What can I do to aid in visitation and lowering my child support.?
A year ago I was ordered to pay child support by the State of California, for a total of about 1000. 00 per month. I am married with two children and I’m in the army. Your most immediate need is to reduce your California child support obligation.
You will continue accruing the debt at $1,000 per month until a new Court Order is obtained.
A number of good DIY books on the subject of reducing California child support are available. The books include all the critical forms and show the step by step process.
My favorites are those published by NOLO PRESS. These are available at larger California book store chains like Barnes & Noble, Borders and even AMAZON.
Yes you can find local Attorneys to file for you and given your military status, i would be shocked by anyone unwilling to cut you a tremendous break. A lot of attorneys have a lot of heart.
You will need to serve the papers on her. You generally need her address. If she has not provided the Court with her new address, you might get Court consent to serve her by mail at her last known address. You might also claim that she abducted the child and seek FBI assistance. The last Court order will indicate of this last drastic action is critical.
A court appearance is generally compulsory but your military status likely exempts you. You will need an attorney to make at least one appearance for you.
I have little military knowledge or experience but does the JAG office provide personal legal assistance or make referrals. If not how about the base Chaplin.

There is something I don’t understand here. You were obviously determined to be the father here as you were ordered to pay child support, but why didn’t you ask for visitation at the same time, even if you weren’t able to exercise it right now? You were given very poor advice as it was better to get that settled at the time of custody and child support. Then when you returned, you would be able to start your visitation immediately. Also, if you had an order of visitation in place, it would have required the mother to provide a phone number so you could have called your child on a regular advice. Also, in some circumstances, the courts have ordered the father to provide the child with a computer and webcam so he can regularly visit his child when he is overseas via webcam. All I can say is don’t go back to the lawyer who so poorly advised you!
Now as for the matter of her moving, were you married to the mother of your child? If not, that gives her rights that she would not have had (ie. the right to move out of state without your permission) she would not have had if you married her. And certainly without something written in the custodial court order, she was free to move as she pleased. That being said, she should be made to provide a phone number so you can contact your child periodically. And you should have the right to know where your child is living so you can send her letters and gifts. But if your court order doesn’t call for it, you will have to have your lawyer ask for it when you go back to court to ask for visitation.
As for your child support, that is usually based on a formula and there may not be much you can do to change it. If you are having trouble supporting the children you have in your marriage, you may find that rather than having your current amount of support lowered, they may expect your wife to get a job to help support HER children. The courts may also say that if you can’t afford to raise this child, you should not have made her (ie. used a condom) while you still had two other children to raise. And it won’t look all that great that you had child support arrears.
You need a lawyer…a better one than you used the last time. Good luck!

Addendum: if she has sole custody of her child and there is no court order forbidding her to move out of state, this is not parental kidnapping and you cannot involve the police in this matter. Before you do anything stupid, I strongly recommend you discuss this with a civilian lawyer.
Get a lawyer licensed to practice in California. You do not have to wait until you return. Go to http://www.calbar.org and go to the Lawyer Referral services link. JAG alone will be be useful in this matter.
Your support of one child should be about 20% of net income in most states.
Regardless of your status with the child’s mother, your military service will mean separation from your child for long periods. And even if you can arrange an assignment in Washington, that will not prevent the mother from moving again. Consult your attorney to find options to improve visitation. My guess is that you did not have a lawyer earlier or the visitation order would have been included.
And, in case others fail to mention this, THANK YOU for making extra efforts to be a real father to your daughter. Even if the child’s mother blocks some of your efforts, you will be ultimately rewarded when you connect and help your daughter.
When she moved did she get a court order to leave the jurisdiction?
Did you not have any visitation at all before hand ordered by the court?
You need to get a lawyer, and file an action asking for custody of the child and in the alternative joint custody and in that pleading you can include the hardship issue
